James Miller is certified as a circuit civil mediator, and is available to mediate cases throughout the state of Florida. His mediations are conducted in accordance with and governed by Florida law and Florida Mediation Rules.

  • $245 per hour for mediation services with a minimum charge of two hours for mediations reserved for less than a full day and four hours for mediations reserved for a full day. 
  • For matters in Seminole, Volusia and Orange Counties there is NO charge for travel.

What is Mediation?

Mediation is the process of the different parties getting together with a neutral and impartial person (the certified mediator) and discussing the different options and opportunities to resolve the issue at hand before having to go to trial. 

A mediator encourages and facilitates the resolution of a dispute without prescribing what it should be. It is an informal and non-adversarial process intended to help the disputing parties reach a mutually acceptable agreement.

During mediation, the mediator is not there to act as a judge or jury and cannot give legal advice. His role is to help reduce obstacles with communication, assist in the identification of issues, explore alternatives and otherwise facilitate voluntary agreements to resolve the dispute.

Mediation is based on the concepts of communication, negotiation, facilitation and problem solving. It is a forum for consensual dispute resolution by the different parties. Each mediation is voluntary and consensual, even though it may be court ordered and attendance is required by the court . The mediation itself is CONFIDENTIAL, unless required or permitted by law, nothing said during the mediation can later be used by the other side.

Mediations can take anywhere from a couple of hours to multiple days. This all depends on the complexity of the case and the number of parties involved.
